Step 1 – Download the Delaware Medical Marijuana Card Certification Application Packet and Contact a Provider

Contact a provider regarding the completion of the application packet’s Provider Certification form. Not every primary care provider will fill out the form or is certified by the state of Delaware to do so. This is the case even if you have medical documentation of a qualifying condition. Unfortunately, providers are under no obligation to recommend medical marijuana to their patients like we do at Green Relief Health.

A provider may only recommend medical marijuana if they have completed a full assessment of your medical history.

Step 2 – Complete the Remainder of the Application Packet

Has your provider at Green Relief Health filled out the Provider Certification form on your behalf? If so, you must complete the rest of the application packet. It contains two pages of demographic/employment information and a Medical Release Form that you must sign and initial.

*Note that you MUST apply within 90 days of the provider’s signature.

Step 3 – Submit Your Application and Pay the Appropriate Fee

Once you complete the application packet, submit it (along with the $50 application fee) to:

You can fill out the application and apply online. However, the Division does not accept faxed and electronic submissions of applications. Also, under certain circumstances, the Division may waive the application fee. You can check whether you qualify for a fee waiver by accessing this form.

The Delaware Health and Social Services department will either approve or deny your application within 45 calendar days. If anything is missing or incomplete, the department will return the form to you with instructions for resubmission. If it rejects your request, you must wait a minimum of six months before you can reapply.

What Conditions Qualify for a Delaware Medical Marijuana Card Certification?

When Delaware legalized medical marijuana it did so under the following conditions. First, you needed a written certification from a provider. He/she had to state that you could “benefit from the therapeutic use of medicinal marijuana.”  Only those diagnosed with one of the following qualifying medical conditions were eligible:

  • Any terminal illness
  • Cancer
  • HIV/AIDS
  • ALS
  • Alzheimer’s disease
  • Multiple sclerosis
  • Decompensated cirrhosis
  • Conditions that cause severe pain
  • Autism that leads to aggressive or self-injurious behavior
  • Wasting syndrome
  • Intractable nausea and seizures
  • PTSD
  • Glaucoma
  • Chronic debilitating migraine

This was the case until September of 2020 and a new law going into effect. It removed qualifying conditions for adults and pediatric patients. Providers in Delaware are now allowed to use their experienced discretion to recommend a Delaware medical marijuana card certification. Essentially, a physician can approve patients with any debilitating condition if they wish. The bill also removed the requirement that only specialists could recommend cannabis for pediatric patients.

Getting Your Delaware Medical Marijuana Card

Since the law requires a provider-patient relationship, any provider must have a consultation with you to meet the requirements of Delaware law. At Green Relief Health we offer two types of visits either for a first time certification or for those renewing their medical cannabis card.

It is important to note that the certification done by a provider will expire if it is not used within 90 days of issue.
